This agreement is effective immediately upon your acceptance and registration, in accordance with the Saudi Electronic Transactions Law and all applicable laws and regulations in the Kingdom of Saudi Arabia. The Arabic language shall be the official language for interpreting this agreement.
Article 1 – Definitions
- The Platform: All forms of the electronic platform provided over the Internet, including websites, mobile applications, or electronic stores.
- Consumer: An individual engaging in e-commerce with the intent to obtain products or services offered via the platform.
- The Agreement: This document, which integrates both the privacy policy and the terms of use for the Hihala Platform.
- Personal Data: Information relating to a living individual that can directly or indirectly identify that individual (e.g., name, email address, phone number, address, ID or commercial registration number, etc.).
- Usage Data: Information automatically collected during your use of the platform, such as IP address, browser type, pages visited, duration of visits, and device identifiers.
- Cookies: Small files stored on your device that enhance your experience and assist in data collection regarding your use of the platform.
- Data Controller: The entity (Hihala Platform) that determines the purposes and means of processing personal data.
- Data Processors: Third parties or entities that process data on behalf of the Data Controller.

Article 2 – Legal Capacity of the Consumer
- The consumer warrants that they are legally competent under Sharia and applicable law to engage with the platform and that their age is not less than eighteen (18) years.
- In the event of providing false information or not meeting the legal capacity requirements, the consumer shall bear all resulting legal responsibilities and any associated compensations.
Article 3 – Nature of the Platform’s Obligation
- Hihala Platform is committed to providing the requested service or product in accordance with the announced specifications and conditions.
- The platform may also offer additional services, such as after-sales support or technical assistance, with all such services being subject to the terms of this agreement.
Article 4 – Platform Usage Regulations
- The consumer agrees to use the platform in accordance with public morals and the applicable laws and regulations in the Kingdom of Saudi Arabia.
- The consumer shall not use the platform or the products and services provided therein for any purpose that violates these standards.
Article 5 – Accounts and Registration Obligations
- During registration, the consumer must provide accurate, complete, and up-to-date information (e.g., name, ID/commercial registration number, mobile number, email, address) and choose a username and a confidential password.
- The consumer is responsible for maintaining the confidentiality of their account details and password, and must immediately notify the platform of any unauthorized access or breach.
- The platform is not liable for any direct or indirect losses resulting from unauthorized disclosure of account information.
- The consumer must use their account exclusively and is solely responsible for any consequences arising from unauthorized access by others. The platform reserves the right to suspend, restrict, or cancel the account.
- The consumer is required to use the platform with seriousness and integrity, providing true, accurate, complete, and lawful information during registration and updating it as necessary.
- Hihala Platform commits to handling your personal information and contact details confidentially; however, it reserves the right to share your personal information with the competent security authorities upon formal request.
- If it is determined that false or non-compliant information has been provided, the platform reserves the right to suspend, freeze, or cancel the consumer’s account without prejudice to its legal rights.
Article 6 – Electronic Communications and Official Channels
- All communications between the platform and the consumer shall be conducted via the email address registered on the platform.
- Electronic communications, notifications, and other messages sent through the platform shall have the same legal standing as written documents and serve as valid evidence for regulatory and legal purposes.
- The platform reserves the right to send general or targeted messages regarding this agreement or updates to its terms.
Article 7 – Amendments to the Agreement and Fees
- The platform reserves the right to modify or update any provision of this agreement or adjust fees without prior notice.
- Fees may be imposed on consumers based on the products, services, or offers requested, or as required by governmental regulations (including taxes and duties).
- Any amendment, suspension, or cancellation of any clause does not affect the validity of the remaining provisions.
Article 8 – Intellectual Property
- All intellectual property rights related to the platform—including its name, logos, symbols, and content—are the exclusive property of Hihala Platform.
- The consumer agrees to respect these intellectual property rights and not to copy, reproduce, or use any of the platform’s intellectual property without explicit permission.
Article 9 – Platform Liability
- Hihala Platform is committed to providing its services and products lawfully and in accordance with applicable regulations in the Kingdom of Saudi Arabia.
- The platform is not liable for any claims arising from errors, negligence, or misconduct by the consumer or any third party (e.g., shipping companies).
- The platform and its representatives guarantee that the products or services provided are legitimate, authorized, and used for lawful purposes.
Article 10 – Access or Membership Restriction
Hihala Platform reserves the right to suspend or cancel a consumer’s membership or restrict access to its services at any time without prior notice and for any reason.
Article 11 – Governing Law and Applicable Regulations
This agreement is governed by and construed in accordance with the laws, regulations, and statutes applicable in the Kingdom of Saudi Arabia and is subject to the jurisdiction of the competent authorities in Saudi Arabia.
Article 12 – General Provisions
- This document constitutes the entire agreement between Hihala Platform and the consumer regarding the use of the platform.
- In the event of any conflict between electronic and printed texts, the electronic version shall prevail.
- The Arabic language is the official language for the interpretation of this agreement.
- This agreement may only be terminated by a decision issued by the platform’s management.
Article 13 – Collection of Data and Privacy
This section explains how Hihala Platform collects, uses, and protects your personal data when you use the platform. By using the platform, you consent to the collection and processing of your data as described herein.
